We have been forwarded a letter Brian Stowell sent to the newspapers and a copy of the response exposing him in his continuing attempts to mislead people. The man really has no shame!!

A letter Brian Stowell sent to newspapers in response to a letter from Onchan resident and former tennant of Onchan Squash Club, Rae Hamilton.

“I am aware of a letter penned by Rae Hamilton, an Onchan resident and former tenant of Onchan Squash Club, which appeared in the section of the newspaper on Tuesday, 13th September 2011, the letter being headed “My grave concern over candidate”.

I was disheartened to read the letter because I had been given no advanced notice of its publication, no opportunity to respond in the press and it has clearly been timed to appear almost on the eve of the General Election.

Mr. Hamilton’s letter represents only one side of the story.

The decision by the Onchan  Commissioners to discontinue the squash facilities at the premises at Onchan Park was a democratic decision made after Mr Hamilton had sold the club.

Prior to taking part in the decision making process, I made a full declaration of my interests and, as will be confirmed by the Clerk to the Commissioners, I am meticulous in registering all of my interests in relation to my position as a representative of the public.

It is indeed true that a Petition for Redress of a Grievance has been presented to Tynwald but Mr. Hamilton’s letter fails to mention that the Petition seeks a public remedy, namely the appointment of a Select Committee of Tynwald to investigate the rules relating to corporate governance in public office.

I am standing as a candidate at the forthcoming election because I have policies and ideas which I think can benefit the residents of Onchan and the Island generally.

I will not be deterred by Mr. Hamilton’s attempt to slur my character.

Rae Hamilton’s letter responding to Brian Stowell’s letter that was sent to the newspapers.

“I read with interest Brian Stowell’s response to my letter, and I would simply correct the factual position.

My letter never mentioned a declaration of interests and it’s seems questionable why he is raising the point now. However to clarify the point any Commissioner making a declaration of there private interests obviously does so for a very good reason.

If a matter arises, which has the potential to undermine their impartiality because of a clash between their private and public interests, then a conflict of interest exists, and they should withdraw from any discussions or voting regarding the matter by the Board. It is very important that they should act properly at all times and be seen to do so. In other words they should be “whiter than white”, and beyond criticism.

Brian Stowell was taking part in the decision to discontinue the squash facilities operated in Onchan and owned by the Commissioners when he was Chairman, and he had a clear conflict of interest because at the same time he was also a Director of an alternative facility, which operated and owned squash courts. Despite being challenged about this clear conflict of interest at the time he failed to withdraw from the matter and actually confirms he cast the deciding vote to close them instead.

He states he made a full declaration of his interests earlier but in view of the forgoing situation, the crucial point here is that he failed to declare his conflict of interest regarding this specific matter, which is a different requirement entirely, and which should have been made in addition to his earlier declaration.

The point is simple, making a full declaration of interests is only the first step, and if a conflict of this interest arises as a result, then a further declaration is required and action should be taken to avoid the conflict, i.e. withdrawal from all discussions and voting on the matter completely. 

Astonishing, although he should never have been involved in the matter, he compounded the problem by actually suggesting in writing his own inappropriate personal reasons for his attitude against the squash fraternity, as the reasons for the closure of the facility.

Because his actions were so unfair as to constitute an abuse of office and because he gloated publicly about the demise of the squash facilities a complaint was made to the Attorney Generals Chambers, as a result of which a Petition for Redress of Grievance has been presented to Tynwald to introduce measures to deter such actions by individuals in future.
